Privacy policy

This Privacy Policy defines the methods of protection of Users' personal data (ie persons using the Store's website, including the Ordering Parties defined below), using the store's website available at the electronic address www.cerames.eu, hereinafter referred to as the "Store".

Lack of acceptance of this Privacy Policy is synonymous with the inability to use the Store's website, including placing Orders.

The administrator of Users' personal data is Ewiza Jan Toczyski with its registered office in Gdynia (81-406) at ul. Tetmajera 60, entered into the National Official Register of Entities of National Economy (REGON) under number 140713415, the owner of the Store who through it and on the terms set out in the Regulations, sell the Goods without the simultaneous presence of the parties, using the telecommunications network, hereinafter referred to as "the Seller".

The scope of data collection

The Seller collects Users' data, in particular those placing Orders ("Ordering Party"), in the manner specified in the Regulations.

In order to set up an account in the Store, the User should provide the data necessary to use the Account service, i.e. name, surname, e-mail address and set the password for the account. In order to place the Order, the Ordering Party should provide data ensuring its feasibility and enabling contact with the Ordering Party, i.e. name and surname, e-mail address, delivery address, as well as telephone number.

The purpose of data collection

The User's personal data is processed in order to:

- conclusion and performance of a contract for the provision of electronic services - in the event that the User uses such services,

- conclusion and performance of a sales contract, including for the consideration of possible complaints,

- in the case of purchase of the Goods, personal data is also collected in the accounting documentation and thus will be processed in order to keep the accountancy of the Seller,

- answering an inquiry sent via the contact form,

- in the event the User wishes to receive marketing content about the Seller, the User's personal data is also processed in order to send such content.

Providing personal data is voluntary, however, it is a condition for the conclusion of a contract for the provision of electronic services, as well as sales contracts. The consequence of not providing personal data for these purposes by the User is the inability to provide services by the Seller and the inability to conclude and perform the sales contract.

In the scope of sending marketing content at the User's request, providing personal data is voluntary, but failure to do so will result in the inability to submit such content.

The User's personal data will not be used to make automated decisions, including profiling.

Legal basis for the processing of personal data

The legal basis for the processing of Users' personal data is:

- the necessity of their processing in order to conclude and perform the contract for the provision of electronic services - if the User uses such services,

- the necessity of their processing in order to conclude and execute a sales contract, including to consider possible complaints,

- in the case of purchase of the Goods - indispensability to fulfill the legal obligation incumbent on the Seller, consisting in keeping the accounts. This obligation results in particular from the generally applicable provisions of law, in particular from the Act of August 29, 1997. Tax Ordinance, Act of September 29, 1994 on Accounting and the Act of March 11, 2004 on Tax on Goods and Services,

- the legitimate interest of the Administrator, consisting in handling correspondence and answering queries,

- in the case where the User wishes to receive marketing content regarding the Seller - the necessity of data processing to achieve the objectives resulting from legitimate interests pursued by the Seller, i.e. to implement marketing activities related to the Seller.

Periods of storage of personal data

- personal data processed in order to conclude and perform the contract for the provision of electronic services - are stored for the period of use of these services by the User in accordance with the Regulations. After ceasing to use the services, the User's personal data regarding: name, surname, e-mail address, telephone number will be stored for a further 3 years for the purpose of handling complaints and claims related to the use of these services;

- personal data processed in order to conclude and execute a sales contract, including for the consideration of possible claims, as well as for the Seller's accounting purposes - are kept until the expiry of periods resulting from the relevant provisions of law, i.e. until the expiration of the tax liability, which may be prolonged, if applicable, for a period of limitation of civil claims,

- personal data processed in order to answer an inquiry sent via the contact form - are kept for the period necessary to process your inquiry.

- personal data processed for the purpose of sending marketing content - are stored for 3 years from the moment of receiving the request to cease sending marketing content. In this case, Users' personal data will be kept only to defend against any claims related to this shipment.

User Rights

The user has the right to decide to what extent his personal data will be used. In particular, the User may at any time withdraw consent to sending marketing content about the Seller to him. Withdrawal of this consent does not affect the legality of the shipment of this content, which was made on the basis of consent before its withdrawal. The consent may be withdrawn from the User's account in the MY ACCOUNT menu, as well as by clicking on the appropriate link contained in the marketing messages sent, as well as using:

The user also has the right to:

- in the case where personal data of the user are processed in order to fulfill the legitimate interests of the Seller (including when the User wishes to receive marketing content regarding the Seller) - the right to object at any time to the User's personal data processing,

- withdrawal of consent to the processing of personal data at any time, if it underlies the processing of your personal data; the withdrawal of consent does not affect the legality of the processing which was carried out on the basis of that consent before its withdrawal,

- lodging a complaint to the Inspector General for Personal Data Protection, whose registered office is in Warsaw at ul. Stawki 2, 00-193 Warsaw. From May 25, 2018, the complaint may be submitted to the supervisory body, ie the President of the Office for the Protection of Personal Data.

The store uses small files, called cookies. They are saved by the server on the computer of the person visiting the Store's website. A cookie file usually contains the name of the domain it originates from, its "validity period" and an individual, random number identifying this file.

Users' personal data may be made available to entities authorized to receive them under applicable law, in particular competent judicial authorities.

Security and protection of personal data

The Seller declares that he processes Users' personal data in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repeal of Directive 95 / 46 / EC (general data protection regulation, hereinafter "RODO"). Disclaimer

This Privacy Policy does not include any information regarding services or goods other than the Seller, which have been posted on the Store's website commercially, guestly, on the basis of reciprocity or not achieving commercial effect.

The Seller shall not be liable for actions or omissions of the Ordering parties, as a result of which the Seller processes the personal data provided by them in the manner specified in this Privacy Policy.
